User Agreement between you and BidMaterial.com The following is the user agreement as presented by BidMaterial.com. You must agree to these terms before you will be able to sell items, request for quotes (RFQ), or bid on them. If you do not accept these terms, please, do not use our services. Once you click the I accept button below, you agree to these said terms of the user agreement below. General - BidMaterial.com is an online marketplace where buyers, sellers, merchants meet to conduct transactions. We are not involved in the actual transactions between Buyers and Sellers. BidMaterial.com takes no responsibility for the truth or accuracy of auction listings, or the quality, safety, or legality of any items offered at auction. BidMaterial.com reserves the right to modify this agreement at any time, without prior notification. When you register as an Auction User ("User"), you are registering as an Auction Bidder and an Auction Seller. BidMaterial.com does not participate in the monetary transactions between Buyers or, Sellers. Any changes to payments and terms not mentioned in the Auction must be agreed upon between Buyer and Seller, memorialized in writing or Email, and be available to BidMaterial.com for review. Unless otherwise stated, all fees and bid prices are quoted in U.S. Dollars. Take Note: Seller/Lister is responsible for the Auction and Request for Quote (RFQ) FEES Seller/Lister is responsible to pay for services/products on RFQ Agreement w/ Buyer Buyer/Bidder is responsible for the final Auction bid price to the Seller Buyer/Bidder is responsible for the services or products on RFQ Agreement w/ Seller
Should any user receive a unique negative feedback upon the first transaction or three unique negative feedbacks (meaning three different users) they will be removed from BidMaterial.com after a review by the website administrator to determine if reasonable to do so.
BidMaterial.com is only providing auction and RFQ services - We only provide services to people interested in selling, buying and submitting quotes for services and merchandise via Internet auction. We do not have control over the items or service requests that are posted in the auction website, and cannot guarantee the authenticity and quality of a said product or service provided. We are not responsible for the actions the sellers or buyers takes, before, during, and after the auction, typographical errors, miss-prints, loss of merchandise/money, damage or failure of equipment, or services not provided due to your visit to this auction site. Use of this site is at your own risk, and content is presented 'As-Is'.
Bidding and Selling - As a user, you may bid and/or sell merchandise and services over BidMaterial.com. As a bidder, you know that placing a bid is a binding contract with you and the seller, and the bid cannot be retracted unless due to fault by the seller of typographical error, or other error, due to human error on the seller's part. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. Placing a bid on this auction website, and winning, then not paying for the product or requested service is illegal in most states, and prosecution can result to you. As a seller, the item that you place up for bid must be real. Once a bid has been placed for your item, you are being placed in a binding contract with the potential buyer of the product, if that bid shall be the highest bid. Once the auction is over, if over reserve price, you are obligated to sell to the potential buyer which is the highest bidder in your auction. If reserve price was not met, you are not obligated in any way to sell this item at all. As a seller, you are not in any way to bid on your own items. If reported, your auction will be deleted.
Selling Items - As a user, you are welcome to put items up for sale in the BidMaterial.com. We do have restrictions on what items you may sell, and what you may not sell. You may not sell illegal merchandise, including pirated software and music, firearms, adult videos, or anything that is affiliated with pornography, etc. Items that are up to bids are subject to review by the administrator of BidMaterial.com and may be removed without prior notice, if in violation with the User Agreement. Auctions that contain direct links to alternative auctions sites may be removed and/or edited.
BidMaterial.com does have some listings "extras" in which a small fee is charged. If fees go in arrears by more than two (2) months and there is a balance greater than $5.00, the account will be suspended until payment is made. When paying fees, BidMaterial.com asks that you evaluate your balance carefully because we DO NOT credit back any remaining balances that go unused.
Privacy - We gather your information so that other people will have it on hand when they win your auction, or you win their auction. Personal information is not sold, rented, without your permission. Personal information sent to a user regarding a product bought or sold on the auction is not to be used for any other purpose, except for communication with the auction item. Users may request contact number from the site administrator of BidMaterial.com should they have difficulty making contact via Email. Acceptance of these terms is also acceptance to receiving periodical Emails from BidMaterial.com for the purpose of informing members of special events and website issue notifications. bid@bidmaterial.com

Offers to sell or buy outside BidMaterial.com - Offers to buy or sell listed items outside of the BidMaterial.com website are not permitted. Offers of this nature are a potential fraud risk for both buyers and sellers and circumvent BidMaterial.com fees. Some examples of offers outside of the BidMaterial.com site: · Using member contact information obtained from BidMaterial.com or using any BidMaterial.com auction system to offer to sell any listed item outside of BidMaterial.com · Canceling a listing to sell to a buyer who became aware of the item through BidMaterial.com · Ending a listing early to sell the item at a higher price to the winning bidder. · Offering to sell an item to a bidder in a Reserve Not Met listing without going through BidMaterial.com · Offering to sell duplicate or additional merchandise to under-bidders without going through BidMaterial.com · Sending unsolicited (without prior permission) commercial Email offers to bidders for the same or similar products that they have bid on in the past. It is acceptable for sellers request for quotes (RFQ) to end a listing early in order to sell an item or a service at the current bid price to the highest or low bidder. Bidders are permitted to contact sellers with requests to end a listing early and sell at the current bid price; however, sellers are under no obligation to honor the request. Violations of these policies may result in a range of actions, including: · Listing cancellation · Limits on account privileges · Account suspension · Forfeit of BidMaterial.com fees on cancelled listings · Loss of Seller status
User Name and Password - Once a party becomes a Member of the BidMaterial.com the Member will select a user name and a password. Members are entirely responsible for maintaining the confidentiality of their user names and passwords. Furthermore, Members are entirely responsible for any and all activities, which occur under a Member's ID and password. Member agrees to immediately notify Bidmaterial.com of any unauthorized use of Member's ID or any other breach of security known to the Member. We will take action accordingly.
Fees and Services - BidMaterial.com does not charge its members to join or bid on listed items. BidMaterial.com does not charge listing fees; however, we do charge for other services, such as closing fees, request for quotes (RFQ), banner advertising and classified ads. For applicable fees, click [fees] on our website. When you list an item or use a service that has a fee you have an opportunity to review and accept the fees that you will be charged based on our Fees schedule, which we may change from time to time. In accordance with our Fee schedule, at the end of each auction BidMaterial.com will charge the agreed fee. If we make any changes to that policy you will be notified at least 14 days in advance. From time to time, BidMaterial.com will offer its members promotional giveaways (for example, no closing fees). BidMaterial.com will notify its members of these promotional giveaways by email and posting it on the site. It is the member’s responsibility to pay all incurring and revolving fees. You must pay your fees and applicable taxes on time. Fees are charged on the first of each month for the previous month’s activities. At the beginning of the month you will receive an invoice outlining the fees in which you owe. You will then have 7 (seven) days to make the payment via the site with either credit card or PayPal. If your account is not settled within 7 days your access to the site may be restricted.
LIMITATION OF LIABILITY – BidMaterial.com shall not be liable for any damages whatsoever, and in particular bidmaterial.com shall not be liable for any special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to this web site or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if bidmaterial.com has been advised of the possibility of such damages. Some jurisdictions do not allow for the limitation or exclusion of liability for incidental or consquential damages, therefore some of the above limitations are inapplicable.
